The majority of cases I prosecuted throughout my career resolved without a trial. District Attorney’s Office’s employ policies and limits on plea bargaining to ensure community safety, public highway safety and criminal accountability – knowing what the considerations are when plea bargaining occurs is essential. DA’s offices will sometimes make exceptions when a defense attorney can point out issues with the case or other factors that would require a prosecutor to take another look at the plea bargaining. Effective plea negotiations require an attorney that can persuasively explain their case and reasonably demonstrate why what they are asking for is not ridiculous. It also requires having an attorney who is trusted.
